Terms of Service

2.1 Eligibility: You must be at least 18 years old and have the authority to enter into this agreement on behalf of your organization.

2.2 Account Security: You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

2.3 Accurate Information: You must provide accurate and complete information during registration and keep it updated.

4.1 Pricing: Current pricing is available at flowen.eu/pricing. Prices are in EUR excluding VAT unless stated otherwise.

4.2 Plans:

• Professional: €199/month (€189/month if billed annually), includes 10 users
• Business: €499/month (€474/month if billed annually), includes 25 users
• Enterprise: From €1,200/month, custom pricing based on requirements

4.3 Additional Users: Professional plans: €15/user/month. Business plans: €12/user/month.

4.4 Billing Cycle: Subscriptions are billed monthly or annually in advance. Payment is due immediately upon subscription.

4.5 Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

4.6 VAT: EU businesses with valid VAT numbers are charged under reverse charge (0% VAT). All others pay applicable local VAT.

4.7 Price Changes: We may change our prices with 30 days' notice. Changes apply to renewals after the notice period.

4.8 Refunds: Monthly subscriptions are non-refundable. Annual subscriptions may be eligible for pro-rata refunds within 30 days of purchase at our discretion.

6.1 By You: You may cancel your subscription at any time through your account dashboard or by contacting support@flowen.eu. Cancellation takes effect at the end of your current billing period.

6.2 By Us: We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due (after 15 days grace period)
• Engage in abusive or fraudulent behavior
• Provide false information

6.3 Data Access After Termination: After account termination, your account becomes read-only for 90 days. You can export your data during this period. After 90 days, we may delete your account data.

6.4 No Refunds on Termination: If we terminate your account for breach of Terms, no refunds will be issued.

7.1 Your Data: You retain all rights to data you upload to Flowen. You grant us a limited license to process and store your data solely to provide the service.

7.2 Our Platform: Flowen, including all software, designs, trademarks, and documentation, is our intellectual property. You may not copy, modify, or reverse engineer our platform.

7.3 Feedback: If you provide feedback or suggestions, we may use them without obligation to you.

8.1 GDPR Compliance: We are fully compliant with EU General Data Protection Regulation (GDPR). All data is stored in EU data centers (OVH, Sweden/France).

8.2 Privacy Policy: Our data processing practices are detailed in our Privacy Policy.

8.3 Data Processing Agreement: Business and Enterprise customers may request a Data Processing Agreement (DPA).

8.4 Data Security: We use industry-standard security measures including AES-256 encryption, SSL/TLS, and regular security audits.

8.5 Your Responsibilities: You are responsible for ensuring your use of Flowen complies with GDPR and other applicable data protection laws when processing personal data of your customers or employees.

9.1 Uptime: We strive for 99.5% uptime but do not guarantee uninterrupted service.

9.2 Maintenance: We may perform scheduled maintenance with reasonable notice. Emergency maintenance may occur without notice.

9.3 Support: Support hours are Monday-Friday 9:00-17:00 CET. Response times vary by plan (Professional: 24h, Business: 4h, Enterprise: 1h).

10.1 Service "As Is": Flowen is provided "as is" without warranties of any kind, express or implied.

10.2 Limited Liability: To the maximum extent permitted by Swedish law, our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

10.3 Exclusions: We are not liable for indirect, incidental, or consequential damages including loss of profits, data, or business opportunities.

10.4 Data Backups: While we maintain regular backups, you are responsible for maintaining your own backups of critical data.

12.1 Governing Law: These Terms are governed by Swedish law.

12.2 Jurisdiction: Any disputes shall be resolved in the courts of Gothenburg, Sweden.

12.3 Informal Resolution: We encourage you to contact us at info@flowen.eu to resolve disputes informally before pursuing legal action.

13.1 Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Industrinät AB regarding Flowen.

13.2 Severability: If any provision is found invalid, the remaining provisions remain in effect.

13.3 No Waiver: Our failure to enforce any right does not waive that right.

13.4 Assignment: You may not assign these Terms without our written consent. We may assign our rights and obligations to any successor entity.
